Summary

We will always do our best to fulfil your needs and meet your goals, but sometimes it’s best to have a few things written down so that we both know what’s what, who should do what and what happens if anything goes wrong.

In our Terms and Conditions you won’t find complicated legal terms or long passages of unreadable text. We simply want what’s best for the safety of both parties, now and in the future. 

We work collaboratively with your team to bring your project to fruition. Our experience in design also connects us with software engineers, photographers, film makers, printers, copywriters, translators and project managers to enhance your project.

Hourly rates and day rates apply where project fees are not in place, guide prices provided below.

What do both parties agree to do?

As our customer, you have the power and ability to enter into this contract on behalf of your company or organisation.

You agree to provide us with everything that we’ll need to complete the project including text, images and other information as and when we need it and in the format we ask for.

You agree to review our work, provide feedback and approval in a timely manner.

Deadlines work two ways and you’ll also be bound by any dates that we set together.

You also agree to stick to the payment schedule that we have agreed.

We have the experience and ability to perform the services you need from us and we will carry them out in a professional and timely manner.

Along the way we will endeavour to meet all the deadlines set but we can’t be responsible for a missed launch date or a deadline if you have been late in supplying materials or have not approved or signed off work on-time at any stage.

On top of this we’ll also maintain the confidentiality of any information that you give us.

Getting down to the nitty gritty:

Design:

We’ll create designs for the look-and-feel, layout and functionality of your web site. This includes a minimum of two main design visuals. You will select one visual then have the opportunity for you to make up to two rounds of revisions.

If you’re not happy with the designs at this stage, you will pay us in full for all of the work that we have produced until that point and you may either cancel this contract or continue to commission us to make further design revisions at our daily rate of £400.

HTML5 and CSS layout templates:

The output code (code supplied from the server to the user agent*) of your website will be HTML markup styled with CSS file(s). We’ll develop these using HTML5 and CSS2.1 and CSS3 for styling.

*The server is the machine which the website is hosted on, the user agent is the device used by someone to view the website – typically a browser such as Microsoft Internet Explorer or Google Chrome.

The landscape of web browsers and devices changes regularly and our approach is to look forward, not back. With that in mind we will test all our markup and CSS in current versions of all major desktop browsers to ensure that we make the most from them.

We will test the website in: Google Chrome, Mozilla Firefox, Microsoft Edge, Safari, Android, Windows Phone 10+ and iOS.

We will not test old or abandoned browsers, for example Microsoft Internet Explorer 7 or 6 for Windows or Mac, previous versions of Apple’s Safari, Mozilla Firefox or Opera unless otherwise specified. If you need us to consider older browsers, we will charge you at our daily rate of £400 for any necessary additional design work, development and testing.

Text content:

We’re not responsible for writing or inputting any text copy. We’ll be happy to help though, and in addition to the estimate we will charge you at £45 per hour for copy writing or content input.

Photographs:

You may supply us with photographs in digital format. If you choose to buy stock photographs we can suggest vendors of stock photography. Any time we spend searching for appropriate photographs will be charged at our standard studio rate of £45 per hour.

SEO

Search Engine Optimisation is a specialist service. MM&B Studio ensure that your web site is prepared in advance with the standard requirements for optimisation. Link building and further activities such as pay per click advertising will be proposed and set up as an ongoing marketing campaign if required.

MM&B Studio work with several SEO teams to provide an efficient optimisation service. Please note an active SEO campaign will take from 3-6 months to reflect an uplift in traffic to your web site.

Marketing

A marketing campaign to drive traffic to your web site is always advisable for those businesses who can not only rely upon word of mouth and organic social sharing. If you require additional marketing services MM&B studio are happy to assist, recommend or work in partnership with your existing suppliers.

Changes and revisions:

We know from plenty of experience that clients may change their mind regarding the design and functionality as the project evolves. We don’t want to limit either your options or your opportunities to change your mind – however we know you need to have a firm idea of costs at the outset.

So we provide a fixed quotation with a detailed scope of work, as the project progresses we are happy to discuss additions to this scope of work and we make it clear from the outset that any such variations will affect the cost of the project.

MM&B Studio quotation prices are based on the number of days that we estimate we’ll need to accomplish everything that you have told us you want to achieve.

This price is fixed for the project and we undertake to deliver the website as per the proposal that we provide at the beginning of every project.

If you do want to change your mind, add extra pages or templates or even add new functionality, that won’t be a problem. This will be charged at our daily rate of £400. Along the way we will ask you to put requests in writing – so we can keep track of changes. We will also advise you of costs for additional work in advance so you can plan your budgets accordingly.

Technical support:

MM&B Studio provide a hosting and support service which varies deepening on requirements. Hosted accounts can contact us for quick jobs which take up to 15 minutes per month. We’ll provide a cost if your request is not achievable within your monthly support agreement.

Website hosting occasionally needs to be reset or hits a problem which interrupts service. You can typically expect your hosted website to be available for 99.9% of a 12 month period.

Our pricing:

• £45 per hour design, animation, artwork, splitting assets and creative production
• £45 per hour basic online text updates
• £45 per hour project management
• £75 per hour web and software development
• £400 MM&B Studio web development day rate

Legal stuff:

We can’t guarantee that the functions contained in any web page templates or in a completed web site or system will always be error-free and so we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate web based systems, even if you have advised us of the possibilities of such damages.

If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed sever-able from this agreement and shall not affect the validity and enforce-ability of any remaining provisions.

MM&B Studio reserve the right to terminate the contract, suspend or discontinue the design and development service at any time for any reason with or without notice.

If MM&B Studio do not receive full and final payment services provided we will take further action to recover funds and in doing so the fees accumulated will also be invoiced.

Copyrights:

You guarantee to us that any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the web site are either owned by your good selves, or that you have permission to use them.

When we receive your final payment, copyright is automatically assigned (where possible) as follows:

You own the graphics and other visual elements that we create for you for this project. Upon request we’ll give you a copy of all files and you should store them really safely as we are not required to keep them or provide any native source files we used to make them.

You also own text content, photographs and other data you provided, unless someone else owns them. You also own the bespoke PHP, JavaScript, HTML, CSS and other code and are free to reproduce or modify it as you see fit.

MM&B Studio websites are built bespoke for most clients developed in house at our offices within the MM&B Studio team.

We do offer simple out of the box systems for lower budget sites. These are built on the WordPress CMS platform.  WordPress is open source software licensed to all those who chose to use it under the GNU General Public License version 2. We love to show off our work and share what we have learned with other people, so we reserve the right to display and link to completed projects as part of our portfolio and to write about the project on web sites, in magazine articles and in books.
